The general terms and conditions of the online store seaeclipse.com are formulated in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1), and the Electronic Communications Act (ZEKom-1).

The online store seaeclipse.com (hereinafter referred to as “store”) is managed by the company CVC d.o.o., Dunajska cesta 144 A, 1000 Ljubljana, Slovenia. Registration number: 6791379000, tax number: SI 10299092, which also acts as the provider of e-commerce services (hereinafter referred to as the seller or seaeclipse.com).

The general terms and conditions govern the operation of the online store, the rights and obligations of the user and the store, and regulate the business relationship between seaeclipse.com and the buyer. They also cover individual rules for purchases at the pickup points of the company CVC d.o.o.

Buyers are bound by the general terms and conditions valid at the time of purchase (placing an online order). Users are individually notified of the general terms and conditions when placing an order and confirm their awareness by submitting the order. The general terms and conditions are also available at the pickup points of CVC d.o.o.

By registering in the online store via email, a visitor becomes a guest of seaeclipse.com, and with a confirmed registration in the online store, they become a member of seaeclipse.com. Both a guest and a member (hereinafter referred to as the user) have the right to make purchases in the online store.

A visitor can register as a store member online, and a one-time entry as a store guest can also be done online.

Upon registration in the online store as a member, the visitor obtains a username, which is the same as the email address, and a password. The username and password unambiguously identify and link to the entered data.

Registration is also possible during the purchase process.

If a user wishes to change their email address at any time, they must send a request to info@seaeclipse.com. The change of the email address will be processed on the same or the next working day, and the user will be notified by email.

The purchase of certain items available in stock at a specific store pickup location is also possible without registering in the online store.

The store undertakes to provide the buyer, before entering into a contract or making an offer, with the following information:

  • Information about the company CVC d.o.o. (name and registered office, registration number),
  • Contact details enabling quick and effective communication (email, phone),
  • Essential characteristics of the items (including after-sales services and warranties) and the validity period of this information,
  • Availability of items (each item offered on the website should be available within a reasonable time),
  • Terms of delivery of items (method, place, and delivery time),
  • Prices, clearly and unambiguously determined, including whether they include taxes and transportation costs, and other charges, and the validity period of this information,
  • Payment and delivery methods or performance, and the validity period of this information,
  • The time frame for accepting the offer,
  • The deadline for withdrawal from the contract and the conditions for withdrawal (description of the right to withdraw in accordance with Article 43c of the ZVPot; in cases where the consumer does not have the right to withdraw in accordance with Article 43c of the ZVPot, this is expressly communicated),
  • Explanation of the complaint handling procedure, including all contact details or the customer service department.

The purchase and sale agreement between the store and the buyer is concluded in the online store when seaeclipse.com sends the buyer the first electronic message regarding the status of their order (with the subject: order receipt confirmation). From this moment, all prices and other conditions are fixed and apply both to seaeclipse.com and the buyer. The buyer is considered a person with the data provided at the time of placing the order. Later changes to the buyer’s data are not possible.

The purchase and sale agreement (i.e., the first electronic message about the order status) is stored in electronic form on the server of seaeclipse.com (owned by the company DHH – domovanje.com).

seaeclipse.com accepts the following payment methods:

  • Cash on delivery only for products not custom-made*
  • Card payment upon delivery only for products not custom-made*
  • Bank transfer to the account of seaeclipse.com based on the offer/proforma invoice**
  • Credit or debit card (MasterCard®, Visa, Visa Electron, American Express) via the STRIPE application
  • PayPal payment (MasterCard®, Visa, Visa Electron, American Express) via online payment

*For specific orders, we reserve the right to request payment by bank transfer based on the offer/proforma invoice, with the price remaining unchanged.

**Upon receipt of payment based on the offer/proforma invoice, the order proceeds to the processing stage.

seaeclipse.com receives a printed invoice along with the delivered items. In the case of personal pickup at the pickup location, the buyer receives a printed/written invoice for the purchased items upon collection.

The invoice itemizes the price and all costs related to the purchase.

The buyer is responsible for verifying the correctness of the data before submitting the order. Objections to the correctness of issued invoices raised later will not be considered.

The online price applies to all registered users of seaeclipse.com who have provided their data to CVC d.o.o. Users become registered store members through registration or a one-time entry as a guest in the online store.

The regular price applies to purchases by unregistered and registered users. Items are available for purchase at the regular price exclusively at CVC d.o.o. pickup locations. The regular price is usually the same as the online price.

If only one price is displayed for an item, it means that the online price and the regular price are the same. If the regular price is crossed out for an item, registered buyers of the online store seaeclipse.com have the option to purchase the item at the online price.

All prices include VAT, unless expressly stated otherwise. Prices are valid at the time of order placement and do not have a predetermined validity period. Prices are valid for payments using the specified payment methods and under the specified conditions.

Despite extraordinary efforts to provide the most up-to-date and accurate information, it may happen that the price information is incorrect. In such cases, or if the item price changes during order processing, seaeclipse.com will allow the buyer to cancel the purchase.

Discounts, promotional codes, etc., are generally not cumulative. Discounts on individual items and promotional codes are cumulative.

Funds received through gift vouchers, bonuses, and prepayments are not interest-bearing. Gift vouchers and bonus codes cannot be exchanged for cash. The redemption of gift vouchers, bonuses, promotional codes, etc., is not possible for purchases at pickup locations.

In the case of payment with payment or credit cards, the following conditions apply:

  • The payer (user’s account details) must be the same person or organization as the owner of the payment or credit card.
  • After confirming the order receipt, changes to the order content or the final order amount are not possible, except with the approval of seaeclipse.com.

In the event of unauthorized use of payment cards, buyers are obliged to notify CVC d.o.o. immediately. The buyer’s claim for a refund due to unauthorized use of the payment card will be considered in accordance with the general terms and conditions.

Delivery Time: The delivery time for items in stock (excluding custom-made) is usually 2-5 working days from the date of order confirmation, except for some exceptional cases (force majeure, unforeseen events, etc.). In the case of longer delivery times or unavailability of items, the buyer will be informed as soon as possible.

For custom-made products, the delivery time is specified individually for each product.

Items are delivered through the delivery services of GLS, or other delivery services depending on the buyer’s location.

Delivery costs depend on the weight of the shipment, the chosen delivery method, and the destination.

The buyer is informed about the delivery costs before confirming the order.

In the case of the personal pickup of items at the pickup location, the buyer is informed about the availability of the items and the pickup time via email or telephone.

The buyer has the right to return items without giving a reason within 14 days of receiving the items. The return period expires 14 days after the day the buyer or a third party designated by the buyer, other than the carrier, takes over the items.

To exercise the right of return, the buyer must notify seaeclipse.com (CVC d.o.o.) of their decision to withdraw from the contract by an unequivocal statement (e.g., a letter sent by post or email). The buyer can use the attached withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for the buyer to send their communication concerning the exercise of the right of return before the withdrawal period has expired.

If the buyer withdraws from the contract, seaeclipse.com shall reimburse all payments received from the buyer, including the cost of standard delivery, without undue delay and in any event not later than 14 days from the day on which seaeclipse.com is informed of the buyer’s decision to withdraw from the contract. seaeclipse.com will carry out such reimbursement using the same means of payment as the buyer used for the initial transaction unless the buyer has expressly agreed otherwise. In any event, the buyer will not incur any fees as a result of such reimbursement.

seaeclipse.com may withhold reimbursement until it has received the items back or the buyer has supplied evidence of having sent back the items, whichever is the earliest.

The buyer must send back the items or hand them over to seaeclipse.com without undue delay and in any event not later than 14 days from the day on which they communicate their withdrawal from the contract to seaeclipse.com. The deadline is met if the buyer sends back the items before the period of 14 days has expired.

The buyer bears the direct cost of returning the items.

The buyer is liable for any diminished value of the items resulting from the handling of the items other than what is necessary to establish the nature, characteristics, and functioning of the items.

Exclusion of the Right of Return: The right of return does not apply to the following contracts:

  • Contracts for the supply of goods made to the buyer’s specifications or clearly personalized – custom-made.
  • Contracts for the supply of sealed goods that are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

If the item is defective, the buyer has the right to demand that seaeclipse.com repairs the item, replaces it, reduces the price, or returns the payment in accordance with the Consumer Protection Act.

CVC d.o.o. does not take responsibility for damaged items caused by the delivery service.

The buyer must notify seaeclipse.com of any defects in the item and submit a detailed description of the defects in writing or by email within the statutory deadline, including a request for repair or replacement, a reduction in price, or a refund.

Items have a warranty if stated on the warranty certificate or on the invoice. The warranty is valid when following the instructions on the warranty certificate and upon presentation of the invoice. Warranty periods are specified on the warranty certificates or on the invoice.

Information about the warranty is also provided on the product presentation page. If there is no information about the warranty, the item either has no warranty, or the information is currently unknown. In the latter case, the buyer can contact seaeclipse.com, which will provide up-to-date information.

seaeclipse.com complies with applicable consumer protection laws. seaeclipse.com has established an effective system for dealing with complaints and has appointed a person who, in case of problems, the buyer can contact by phone or email.

The complaint procedure is confidential.

seaeclipse.com will confirm receipt of the complaint within five working days and inform the buyer about the progress of the procedure. seaeclipse.com is aware that the essential characteristic of a consumer dispute is its disproportion between the economic value of the claim and the costs incurred in resolving the dispute, which is also the main obstacle to the consumer not initiating a dispute before a court.

Therefore, seaeclipse.com strives to the best of its ability to resolve any disputes amicably.

In the event of legal disputes, the court with territorial jurisdiction is determined according to the buyer’s place of residence.

seaeclipse.com undertakes to permanently protect all personal data of users.

seaeclipse.com will use the personal data of users exclusively to fulfil the order (sending information material, offers, invoices) and other necessary communication.

The user’s data will not be passed on to unauthorized persons under any circumstances.

To ensure security, seaeclipse.com collects certain data about users, including IP addresses, from which users access the online store. seaeclipse.com uses this data to identify and verify the user’s identity.

By registering on the website or making a purchase, the user agrees to receive promotional emails. The user can opt-out of receiving promotional emails at any time.

These general terms and conditions are drawn up by Slovenian legislation. Any disputes between seaeclipse.com and the buyer will be resolved amicably, and if an amicable settlement is not possible, the dispute will be referred to the competent court in Ljubljana, Slovenia.

seaeclipse.com reserves the right to change the general terms and conditions at any time and in any way, regardless of the reason and without prior notice.

In the event of changes to the general terms and conditions, seaeclipse.com will publish the amended text on the website www.seaeclipse.com and will ensure that the user is informed of the changes.

The general terms and conditions are valid from the date of publication and apply to all users who register or make a purchase after that date.
